Lucon Driver App (Operator/Driver Partner)

These Driver Terms & Conditions (“Terms”) govern your access to and use of the Lucon Driver App and related services (“Platform”). By registering, accessing, or using the Platform as a driver/transport operator, you represent that you are at least 18 years old and you agree to these Terms.

1) Definitions

  • “Company” means Lucon and its operators (“we”, “us”, “our”).
  • “Driver/Operator/Partner” means you, the independent service provider using the Platform.
  • “Passenger/Customer” means a user requesting transportation/tour services.
  • “Booking” means a trip, transfer, tour, or service request made through the Platform, including ground transportation and (where enabled) boat/water transport services.
  • “Content” includes text, photos, documents, messages, and other data on the Platform.

2) Relationship & Independent Contractor

You operate as an independent contractor and not as an employee, agent, joint-venture partner, or representative of the Company. You control your own schedule, routes, equipment, and methods of service. You are solely responsible for all taxes, permits, insurance, and compliance obligations.

3) Eligibility & Account Registration

  • You must be 18 years of age or older to register and use the Platform as a driver/operator.
  • You must be legally allowed to provide transportation and/or tour services in your jurisdiction.
  • You must provide accurate registration information and keep it updated.
  • You must maintain secure access to your device and account credentials.
  • We may request identity verification and compliance checks where lawful and applicable.

4) Driver Requirements (Compliance)

You agree to maintain valid documents at all times, including (where applicable):

  • Valid driver’s license and any required endorsements
  • Valid vehicle registration, inspection, and permits
  • Commercial/appropriate insurance coverage
  • Any tourism/transport authority permits required for tours/transfers
  • Safe, roadworthy vehicle condition and required safety equipment

Water/Boat Services (if enabled)

If you accept boat/water transport bookings, you must maintain all marine-related licenses, registrations, permits, and safety compliance requirements applicable to your jurisdiction.

  • Any required captain/operator certification or license
  • Valid boat registration and inspections (where applicable)
  • Required safety equipment (e.g., life vests) and passenger safety compliance
  • Any port authority / maritime permits required for commercial operations
Important: If your documents expire, are suspended, or become invalid, you must stop accepting bookings immediately and update your documents before continuing.

5) Using the Platform

Accepting & Completing Bookings

  • When you accept a booking, you agree to perform the service as described (time, location, capacity).
  • You must arrive on time and communicate promptly if delays occur.
  • You must follow local traffic/maritime laws and operate safely.
  • You must treat passengers with respect and provide a professional experience.

Communication

The Platform may provide in-app chat/calls. You agree to communicate professionally and only for booking-related purposes. Harassment, threats, discrimination, or abusive language is prohibited.

6) Safety Standards

  • No alcohol/drug impairment while online or providing services.
  • No unsafe driving/boating behavior (speeding, reckless maneuvers, phone use while moving, etc.).
  • Follow passenger capacity limits and safety requirements (seat belts, life vests, etc.).
  • Maintain cleanliness and basic hygiene standards.
  • For boat services: comply with all maritime safety rules, provide required safety briefings, and ensure required safety equipment (e.g., life vests) is available and used where required.

7) Pricing, Fees & Payments

Booking prices may be set by the Platform, by an agreed rate card, or by you where permitted. The Company may charge service/marketplace fees, processing fees, or subscription fees as disclosed in the app or dashboard.

  • Payout schedules and methods may vary based on payment provider and policy.
  • You are responsible for accurate bank/payment details for payouts.
  • Chargebacks, fraud, or disputes may result in temporary holds or deductions as permitted by law.

8) Cancellations, No-Shows & Disputes

  • Cancellation and no-show rules may be defined by Platform policy and shown to drivers and passengers.
  • Repeated late cancellations or failure to honor accepted bookings may result in penalties or deactivation.
  • If a dispute occurs, you must cooperate by providing trip details, messages, photos, or other evidence.

9) Ratings & Quality Control

Passengers may rate trips and submit feedback. We may use quality signals (ratings, cancellations, complaints, safety reports) to monitor service quality and take actions including warnings, suspension, or removal.

10) Prohibited Conduct

  • Using the Platform for illegal activities or violating any law/regulation
  • Harassment, discrimination, hate speech, or abusive behavior
  • Soliciting passengers outside the Platform to avoid fees (“off-platform transactions”)
  • Uploading false or forged documents
  • Providing services without valid required documents (including marine documents for boat services)
  • Sharing passenger personal information without authorization
  • Attempting to hack, scrape, reverse engineer, or disrupt the Platform

11) Data, Privacy & Location

The Platform may collect and process location data to enable bookings, navigation, safety features, customer support, and fraud prevention. Use of personal data is governed by our Privacy Policy.

12) Driver Content (Photos, Documents, Messages)

  • You retain ownership of your content, but you grant the Company a license to store and display it to operate the Platform.
  • You must ensure you have rights to upload any photos or documents.
  • We may remove content that violates these Terms or applicable policies.

13) Devices, Connectivity & Charges

You are responsible for obtaining and maintaining compatible devices, data plans, and connectivity. Carrier and data charges may apply. We do not guarantee uninterrupted availability of the Platform.

14) Suspension & Termination

We may suspend or terminate your access if we believe you violated these Terms, created safety risks, provided fraudulent information, received repeated complaints, or for other lawful reasons. You may stop using the Platform at any time.

15) Disclaimers

The Platform is provided “as is” and “as available.” We do not guarantee that bookings will be available or that earnings will meet any minimum amount. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

16) Limitation of Liability

To the fullest extent permitted by the laws of Saint Lucia, Lucon operates solely as a technology platform that connects users with certified taxi operators, drivers, and tour providers. Lucon does not own, operate, or control vehicles or vessels and does not employ drivers, operators, or tour providers. Drivers and operators using the Platform are independent third-party service providers and not employees of Lucon.

  • Lucon shall not be liable for any damages, losses, or claims arising from or related to transportation, tour, or other services provided by you or other third-party operators, including personal injury, death, accidents, property loss, negligence, misconduct, or unlawful acts.
  • By using the Platform, you acknowledge that transport and tour services involve inherent risks, including accidents, personal injury or illness, property loss, delays, weather disruption, road closures, mechanical failures, marine incidents, and other unforeseen circumstances.
  • To the maximum extent permitted by law, Lucon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of income, profits, business, opportunities, goodwill, or data.
  • Lucon’s total liability for any claim arising out of or in connection with your use of the Platform shall be limited to the amount of fees paid by you to Lucon for the specific booking or service giving rise to the claim, or where no booking-specific fee applies, the fees paid by you to Lucon in the three (3) months preceding the event giving rise to the claim, to the extent permitted by law.
  • Lucon may assist with communication and will use reasonable efforts to help resolve disputes or issues, but Lucon is not responsible for the underlying services provided by independent operators or for disputes between drivers, operators, passengers, and third parties.
  • Lucon shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including weather conditions, government actions, road or port conditions, closures, strikes, connectivity failures, mechanical failures, accidents, or other force majeure events.
  • Nothing in these Terms excludes or limits liability that cannot legally be excluded under the laws of Saint Lucia, including liability for fraud, fraudulent misrepresentation, or any other non-excludable liability. If any provision of this section is found invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17) Indemnity

You agree to indemnify and hold harmless the Company from claims, damages, liabilities, and expenses arising from your services, your violation of these Terms, your negligence or misconduct, or your breach of law.

18) Changes to the Terms

We may update these Terms from time to time. We will post updates on this page and/or inside the app. Continued use after an update means you accept the revised Terms.

19) Governing Law

These Terms are governed by the laws of Saint Lucia, without regard to conflict-of-law rules.
